Terms of Service

IMPORTANT NOTICE: Please read these Terms of Service carefully. By using this website, interacting with the Dateverse Explorer, or participating in the Dateverse protocol, you acknowledge that you understand and agree to be bound by all clauses in these terms, including the binding arbitration and waiver of class action provisions.

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you (the user) and the developers, custodians, and community maintainers of Dateverse ("we," "us," or "our"). These Terms govern your access to and use of the Dateverse website located at dateverse.io, including any redirect domains, subdomains, and the decentralized temporal registry interface (collectively, the "Site").

By accessing or using the Site, you represent that you are at least 18 years of age (or the legal age of majority in your jurisdiction) and possess the legal authority to enter into these Terms. If you do not agree to these Terms, you must immediately cease all access and use of the Site.

2. The Dateverse Protocol & Smart Contracts

Dateverse is a decentralized digital collectible protocol built around scarce calendar dates. The core registry of dates operates on public, decentralized blockchain networks via smart contracts.

  • Decentralized Interface: The Site serves as a graphical interface (the "Explorer" or "dApp") designed to facilitate interactions with public smart contracts. We do not own, control, or operate the underlying blockchain networks.
  • Non-Custodial: We do not have custody or control over your digital assets, private keys, or crypto wallets. Wallet connections are initiated directly by the user through third-party browser extensions (e.g. MetaMask).
  • Irreversibility: All smart contract interactions, including minting and transferring temporal collectibles, are irreversible and recorded permanently on the public ledger. We cannot revert, cancel, or modify transactions.
  • Gas Fees: Transactions on the blockchain require the payment of network transaction fees ("Gas"). You are solely responsible for ensuring you have sufficient funds to cover gas fees associated with your actions.

3. Scarcity & Genesis Range Rules

The protocol operates under strict, immutable chronological constraints defined within the smart contracts. By interacting with Dateverse, you acknowledge:

  • The Genesis range is limited strictly from January 1, 1950, to December 31, 2049. This constitutes a total finite supply of 36,525 unique calendar dates.
  • Each date can only exist and be owned once in the canonical registry.
  • No expansion of the date range, duplicate dates, or inflation of the token supply is supported by the contract logic.

4. User Responsibilities & Wallet Security

To use the interactive features of the Site (such as minting or claiming dates in the Explorer), you must connect an external Web3 wallet. You agree that:

  • You are solely responsible for securing your wallet credentials, private keys, and seed phrases. We will never ask for your private key, and we cannot recover credentials.
  • You assume all risk associated with unauthorized access to your wallet or transactions executed under your signature.
  • You must comply with all applicable local, national, and international laws, regulations, and tax obligations related to digital asset custody and transactions.

5. Prohibited Activities

You agree not to engage in any of the following prohibited behaviors while using the Site:

  • Violating any applicable law, including anti-money laundering and sanctions regulations.
  • Circumventing or attempting to bypass security features, rate limits, or access controls.
  • Using automated scrapers, bots, or script frameworks to flood the minting pipeline or manipulate market metrics.
  • Attempting to attack, exploit, or inject malicious scripts into the Site frontend or backend support systems.

6. Intellectual Property Rights

The design, layout, custom icons, typography, and frontend assets of the Site are protected by copyright and intellectual property laws. Unless otherwise specified under an open-source license:

The brand names, logos, and custom graphics associated with Dateverse are our proprietary marks. The smart contracts deployed on-chain are open-source and governed by their respective licenses (e.g. MIT).

7. Disclaimers of Warranty

THE SITE AND THE DECENTRALIZED EXPLORER ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Site will be error-free, uninterrupted, or secure, or that the smart contracts will perform without bugs or vulnerabilities. Blockchain transactions involve inherent risks; you acknowledge and accept these risks before executing contracts.

8. Limitation of Liability

IN NO EVENT SHALL THE CUSTODIANS, DEVELOPERS, OR CONTRIBUTORS OF DATEVERSE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, OR DIGITAL ASSETS, ARISING OUT OF OR IN CONNECTION WITH THE SITE, THE PROTOCOL, OR SMART CONTRACT INTERACTIONS, REGARDLESS OF THE THEORY OF LIABILITY.

Our total aggregate liability under these terms shall not exceed one hundred United States dollars ($100 USD).

9. Indemnification

You agree to defend, indemnify, and hold harmless the Dateverse developers, operators, and community contributors from and against any claims, damages, liabilities, losses, costs, or expenses (including reasonable attorneys' fees) arising out of your breach of these Terms, your misuse of the Site, or your violation of third-party rights.

10. Governing Law & Dispute Resolution

These Terms shall be governed by, and construed in accordance with, the laws of the jurisdiction where the protocol curators reside, without regard to conflict of law principles. Any dispute arising from these Terms shall be resolved exclusively through binding, individual arbitration. You waive any right to participate in class actions or jury trials.

11. Modifications to Site and Terms

We reserve the right, in our sole discretion, to modify, update, or discontinue the Site frontend at any time. We may update these Terms from time to time. Your continued use of the Site following the posting of changes constitutes acceptance of the updated Terms.
